IGLYO Statement on New Anti-LGBTQI Amendments to Slovakia's Constitution

We Condemn Slovakia’s Dark Turn for our Fundamental Rights

Slovakia has just taken a dark turn with the adoption of amendments to its constitution despite the relentless work of our Members and activists on the ground, and the continuous advocacy efforts of international civil society. These amendments are a direct attack on LGBTQI communities and fundamental rights in the country. 

Amongst other changes, Slovakia’s constitution will now only recognise two “sexes” — “male” and “female” —, limit adoption to married heterosexual couples, and, very worryingly, make Slovakian law prevail over international law — including EU legislation. Additionally, parental approval will now be required for learners to access comprehensive sexuality education (CSE) in schools. 

As shown in many European studies and in IGLYO’s education work, the implementation of comprehensive sexuality education (CSE) helps to realise a range of children’s human rights. Recognising the close connection between children’s rights and CSE provides a new way to frame the child as a rights-holder who can demand that the state take positive action to provide such education. 

These amendments are a threat to all children’s rights and send a terrifying message to our communities in Slovakia, in particular to trans and intersex youth, casting even more shadow on a landscape where their existence and identities were already not legally recognised and erased.

Our lives and dignity are not worth less than so-called “traditional values”. We call on the European institutions to hold Slovakia accountable for acting against EU values and law, and passing amendments that fail to respect the Charter of Fundamental Rights.
